By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. Our [Privacy Policy](https://yupolearn.com/privacy/) explains how we process personal data. It is incorporated into these Terms by reference. ## 1. Eligibility and accounts - You must be able to enter a binding agreement in your jurisdiction to use the App. - The App is not directed at children under the age required in your country to consent to data processing without parental permission. Do not use the App if you do not meet that age. - You may sign in with email or use features that rely on an anonymous or linked session, as the App provides. You are responsible for keeping your credentials confidential and for activity under your account. ## 3. License to use the App Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial learning use, unless we agree otherwise in writing. You may not: copy the App except as permitted by law; reverse engineer, decompile, or attempt to extract source code except where mandatory law allows; rent, lease, sublicense, or sell access to the App; remove legal notices; or use the App to build a competing product or service. ## 4. Acceptable use You agree not to: - Violate applicable laws or third-party rights - Interfere with or disrupt the App, servers, or networks - Attempt unauthorized access to accounts, systems, or data - Upload malware or misuse APIs or automation in a way that harms the service or other users - Harass, abuse, or harm others through the App - Circumvent technical limits, paywalls, or subscription checks We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the service or others. ## 5. Subscriptions, in-app purchases, and ads - **Paid features.** Some features may require a subscription or one-time purchase processed through the Apple App Store or Google Play. Pricing, billing, renewal, and cancellation follow the store’s terms and your account settings there. - **Third-party billing.** We use providers (e.g. Adapty) to help manage subscriptions and entitlements. Payment processing is handled by Apple or Google; we do not receive your full payment card details. - **Advertising.** The App may show ads (e.g. via Unity LevelPlay and its mediated ad networks). Ad delivery may use identifiers and settings subject to your device and consent choices (e.g. App Tracking Transparency on iOS). Refunds and billing disputes for store purchases are generally handled under Apple’s or Google’s policies. ## 6. Third-party services The App relies on third-party infrastructure and SDKs (including but not limited to Supabase, Microsoft Azure Translator, Unity LevelPlay and its mediated ad networks, Adapty, optional Inworld TTS, Expo-related services, and platform services from Apple and Google). Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services outside our reasonable control. ## 7. Content and intellectual property - **Our content.** The App, its design, branding, and our materials are owned by us or our licensors and protected by intellectual property laws. - **Your content.** You retain rights to content you provide. You grant us a worldwide, non-exclusive license to host, process, and display that content only as needed to operate and improve the App and related services, consistent with our Privacy Policy. - **Feedback.** If you send suggestions or feedback, we may use them without obligation to you. ## 8. Learning content and accuracy The App provides educational and language-learning tools. We strive for quality but do not guarantee that content (including translations or pronunciations) is complete, error-free, or suitable for any particular purpose. You use the App at your own discretion. ## 9. Disclaimers **To the maximum extent permitted by applicable law**, the App and all related services are provided **“as is”** and **“as available”**, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or free of errors or harmful components. ## 10. Limitation of liability **To the maximum extent permitted by applicable law**, we and our affiliates, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from your use of the App. Our total aggregate liability for any claims arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us for the App or subscriptions in the twelve (12) months before the claim, or (b) **fifty euros (€50)** if you have not paid us anything—unless mandatory law requires otherwise. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. ## 11. Indemnity You will defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, violation of these Terms, or violation of third-party rights, to the extent permitted by law. ## 12. Changes to the App and Terms We may modify, suspend, or discontinue the App or any feature at any time. We may update these Terms by posting a new version and updating the “Last updated” date. Material changes may be communicated in the App or by email where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms, except where mandatory law requires your explicit consent. ## 13. Termination You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or if we need to comply with law or protect the service. Provisions that by their nature should survive (including licenses granted to us for feedback, disclaimers, limitations of liability, and indemnity) will survive termination. ## 14. Governing law and disputes Unless mandatory consumer protection rules in your country give you the right to bring claims in your local courts, these Terms are governed by the laws applicable to **3dbastir**’s place of establishment, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive jurisdiction, subject to any non-waivable rights you have as a consumer. If you are in the European Union, you may also have the right to use the EU online dispute resolution platform for consumer disputes, where applicable. ## 15. Miscellaneous - **Entire agreement.** These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App. - **Severability.** If any provision is invalid, the remainder remains in effect. - **No waiver.** Failure to enforce a provision is not a waiver. - **Assignment.** You may not assign these Terms; we may assign them in connection with a merger or sale of assets. _This document is for information only and does not constitute legal advice._
